My client’s sometime experience frustration when they want firm answers on Spousal Support (alimony). Our wonderful state does not have a set formula to calculate spousal support. The amount and duration is at the discretion of the court with statutory guidelines. We practicing family law attorneys WISH we had a formula that we could plug in the numbers but we don’t. The court first looks at a parties need and the other parties ability to pay. Then to determine the amount and duration looks at the facts of the marriage considering the length of the marriage, the receiving parties work history and what it will take to get them back to earning an income, the level of lifestyle the parties had while married, and any special circumstances (disabilities, etc). . This is one area where experience counts when you are looking for representation. And ladies and gentlemen, this is a progressive county and parties are expected to get back into the work force.
